Terms of Service

The Listed is a product of 11x Labs Pty Ltd (ABN 84 697 809 144), a company registered in Western Australia. By accessing or using The Listed website or services, you agree to be bound by these Terms of Service.

1. Eligibility

You must be 18 years of age or older and have the authority to bind your organisation to these Terms. By using The Listed, you represent that these conditions are met.

2. Services

The Listed provides AI-assisted podcast production, distribution, and content services for B2B professional services firms. Specific deliverables, volumes, and service terms for your plan are governed by your service agreement with 11x Labs Pty Ltd, which takes precedence over these general Terms where there is any conflict.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access or suspected security breach.

4. Acceptable Use

You must not use The Listed to:

• Engage in any unlawful activity
• Interfere with or disrupt our systems or infrastructure
• Attempt to gain unauthorised access to any part of the service
• Copy, reproduce, or redistribute proprietary materials without permission
• Transmit malware, spam, or harmful code

5. Intellectual Property

11x Labs Pty Ltd retains all intellectual property rights in the The Listed platform, website, and underlying technology. Intellectual property in content produced specifically for your organisation is governed by your individual service agreement.

6. Payment Terms

Invoices are due net 30 days from the date of issue unless otherwise agreed in writing. All prices are exclusive of GST. Late payments may incur interest, and services may be suspended for non-payment. Overage minutes are billed at your plan's effective per-minute rate plus 20%.

7. Confidentiality

Both parties agree to maintain the confidentiality of the other party's proprietary or sensitive information. This obligation survives the termination of your engagement with The Listed.

8. Limitation of Liability

To the maximum extent permitted by law, 11x Labs Pty Ltd's total liability to you will not exceed the amount paid by you for The Listed services in the 12 months preceding the relevant claim. We exclude liability for indirect, incidental, or consequential damages.

9. Australian Consumer Law

Nothing in these Terms limits any rights you have under the Australian Consumer Law, including statutory guarantees, rights to rectification, and refunds for major service failures.

10. Governing Law

These Terms are governed by the laws of Western Australia. You agree to submit to the exclusive jurisdiction of the courts of Western Australia for any disputes arising under these Terms.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of The Listed after changes are published constitutes acceptance of the updated Terms. The "Last updated" date at the top of this page reflects the most current version.
